General Terms & Conditions of Sale

(In compliance with Chapter I, Title 3, Part 3, of the Legislative Decree 206/2005 and subsequent amendments and additions)

1. Requirements and application of the General Terms & Conditions of Sale

The present General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) have as their object the regulation of the purchase of goods and products made at a distance and rendered available, through the Internet, on the website www.sicilywildexperience.com (hereinafter referred to as the “Website”) in compliance and pursuant to the regulations of the Italian Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter referred to as the “Consumer Code”).

The consumer accessing the Website to place an order (hereinafter referred to as the “Customer”) is required, before placing the order, to carefully read the following General Terms & Conditions of Sale that have been made available on the Website and that will be available at any time for the Customer.

Should the person purchasing goods on the Website require an invoice and/or should he/she not be a “consumer or user” (as defined by the Article 6, Section I, Letter a, of the Consumer Code), the Directive regulating the right of withdrawal pursuant to art. 7 and 8 of the present General Conditions and – more generally – the provisions that in accordance with the same Consumer Code apply only to “consumers will not be applied.

Contracts concluded with Azienda Agrovenatoria Trinità through the Website are governed by the present General. Sales Terms and Conditions in complete compliance with the provisions of Italian laws. Italian is the language used for executing contracts with the Vendor.

2. Selecting and ordering products

The characteristics and prices of the products offered for sale on the Website (hereinafter referred to as “Product” or “Products”) are provided on the page related to each Product.

In order to purchase a Product, the Customer will be asked to fill out and submit the Order Form in an electronic format, in accordance with the instructions provided on the Website. The Customer will be asked to add the Product in the “Cart” and, after having read the GTC and the Privacy Policy and having confirmed their acceptance, the Customer will be asked to enter in the details of shipment and billing (if any), to select his/her preferred method of payment and to confirm the Order.

By placing an Order, which is valid as contract proposal, the Customer acknowledges and states that he/she has reviewed and accepted all the indications provided during the purchase procedure and that he/she accepts in full the present GTC and the indicated conditions of payment.

The contract stipulated between Azienda Agrovenatoria Trinità and the Customer shall be intended as concluded when the the Order is accepted by Azienda Agrovenatoria Trinità. This decision is notified to the Customer through a confirmation e-mail containing a summary of these General Terms and Conditions of Sale, the Order number, the shipping and invoicing details, the list of the Products ordered with their essential characteristics and total price, and the delivery costs. The Customer is asked to check the confirmation e-mail within 12 hours and to report possible mistakes to the Customer Service. The Customer is asked to report possible mistakes to the Customer Service within 12 hours of receipt of such e-mail, and to do it directly through the Website by using the dedicated contact form accessible through the tab “Contacts”/ “Contact us”. After this deadline, the Order will be processed to be shipped and changes or modifications will no longer be accepted without prejudice to Customer's other rights according to the subsequent article 7.

Upon receipt of the order from the Customer, Azienda Agrovenatoria Trinità will verify the availability of the stock to fulfil the order. Should one or more Products not be available, the Customer Service will notify it promptly through e- mail to the Customer which, within the following 12 hours, will reply to confirm the shipment of possible other available Products or to cancel the Shipment. In the absence of any reply within such time period, the Order will be considered as confirmed and the available Products will be shipped. In such a situation, the entire amount to be paid for the missing Product will be returned to the Customer or, depending on the chosen payment method, will not be charged.

3. Product information

The information on the Products and their characteristics are available on the Website with the relevant product codes.

The visual representation of the products displayed on the Website, where available, usually matches the photographic image presented in the Descriptive Sheet. It is understood that the Product images have the sole purpose of presenting them for sale and cannot be perfectly representative of their characteristics and qualities, and may differ in colour and size. In the event of a discrepancy between the image and the written Descriptive Sheet, the description in the Descriptive Sheet shall always prevail in case of doubt.

4. Prices and Shipment

All the prices on the Website are established in Euro and they include any VAT and applicable feesShipping costs are included in the product cost. 

Deliveries are carried out throughout the territory of the EU.

  • Shipments in Italy:

Shipments within the Italian territory are made through the express courier GLS. All shipments are performed by and not later than Tuesday, in order to guarantee an efficient service.

  • Shipments abroad (outside Italy, within the EU territory)::

Shipments outside of the Italian territory, but within the EU, are carried out through the express courier DHL.

5. Payment and billing methods

5.1 Payment methods

The Customer may pay for the Products and the shipping expenses by PayPal or by anticipated bank transfer.

  • PayPal/Credit Card

Once the order has been confirmed, the Customer can pay directly through his/her PayPal account, credit card (even a prepaid one) and in any case in accordance with the methods accepted by PayPal and in compliance with its conditions.

  • Anticipated bank transfer

The Customer will be asked to finalize his/her bank transfer within 3 days from the date of the order for orders related to Products, and within 1 day from the date of the order for orders related to Events and/or Courses/Classes. Should it not occur, the order will be canceled and the Products will be listed again on the Website and rendered available to other Customers. The Customer who has not been able to finalize the bank transfer could be contacted by the Customer Service in order to determine if the reason for the Credit Failure is attributable to the Customer’s will not to confirm the purchase or to other causes.

In the bank transfer, it has to be specified the reference number of your order given at the moment of the purchase, and the date in which it has been carried out. These data can easily be found in the confirmation email (ie. “Order 01/01/14 n. 100012345”).

5.2 Invoicing process

If the purchase is carried out by a professional subject, he/she can ask for the issue of the invoice by ticking the dedicated box at check-out and by entering the billing information (fiscal code and/or VAT Number included). In that case, an invoice for your order will be sent via e-mail at the address that you have indicated. The professional subject is responsibe for the correct entry and sharing of billing information and data, and he/she is expressly informed that, if no such invoice request is presented at check-out, it will not be possible to request it subsequently.

6. Transportation and delivery

The Products purchased on the Website will be delivered at the address indicated by the Customer during the purchasing procedure in the dedicated field “Shipping details”.

All the Purchases will be delivered by an express courier (hereinafter referred to as the “Courier”) from Monday to Friday, except on public holidays and during holiday periods. Azienda Agrovenatoria Trinità is not liable for any unforeseeable delay or for delays not imputable to it.

Once the Product(s) have been sent, the Customer will receive a confirmation e-mail in which will be included the shipping tracking code and a link that will permit the Client to track it in real time.

In any case, without prejudice to cases of force majeure or fortuitous events, the ordered Products will be delivered within a maximum of 3 (three) working days with effect from the day following the date in which Azienda Agrovenatoria Trinità has confirmed the order to the Customer through a specific confirmation email.

7. Right of withdrawal

The Customer has the right to withdraw from the contract in accordance with the provisions of Italian legislative decree d.lgs. n.21 del 21 febbario 2014.

You have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period shall expire14 days after the day upon which the Customer, or a third party other than the carrier indicated by the Consumer, acquires the physical possession of the goods.

To exercise his/her right of withdrawal, the Customer must inform us of his/her decision to withdraw from the contract by a clear statement that has to be sent within the abovementioned deadline in the form of a registered letter with acknowledgement of receipt marked for the attention of:

To meet the withdrawal deadline, it is sufficient for the Customer to send his/her communication concerning his/her exercise of the right of withdrawal before the withdrawal period has expired.

For this purpose, the Customer may use any unequivocal written statement setting out the decision to withdraw, provided that such notice is sent to the abovementioned address in the forms and within the respective abovementioned maximum time limits.

Shall the Right of Withdrawal be excluded, Sicily Wild Experience will return to the Customer the Products purchased by him/her and will charge him/her the redispatch costs.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, net of the amount of the shipping costs (for shipments without undue delay) and in any case within and not later than 14 days from receipt of the goods. We will carry out such reimbursement using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any fees as a result of such reimbursement.

The Customer will have to bear the direct cost of returning the goods.

Exceptions

The right of withdrawal is also excluded in the following cases, in accordance with Art.59 of Legislative Decree d.lgs 21/2014:

contract for the supply of goods which are liable to deteriorate or expire rapidly.

8. Conditions and limitations on liability

Information provided to our customers about our Products are constantly updated, however, it is not possible to guarantee the complete absence of errors. Therefore, Azienda Agrovenatoria Trinità cannot be considered responsible for any of them, except in case of specific intent or serious negligence.

Azienda Agrovenatoria reserves the right to amend the errors and inaccuracies also after that the order has been submitted and furthermore reserves the right to amend or modify the information on the Website at any time without prior communication, without prejudice to the right of the Customer and under the present General Conditions and Consumer code.

Except in the case of fraud or serious misconduct, the Customer is not entitled to compensation for damages or indemnity, and Azienda Agrovenatoria shall be considered exempt from any contractual or non-contractual liabilities for direct or indirect damages caused by the non- acceptance, even partially, of an Order.

Azienda Agrovenatoria Trinità promotes the moderate and responsible consumption of alcohol and excludes any liability, except in cases of fraud or serious misconduct, in the case of purchases made by minors under the age of 16.

9. Applicable law and competent court

This Contract between the Customer and Azienda Agrovenatoria Trinità was drafted and shall be interpreted according to Italian Law. For settling any disputes regarding the interpretation, execution and resolution of the present General Conditions or regarding individual orders, if the Customer is a consumer according to what stated in the Consumer Code, he/she will be subject to the exclusive jurisdiction of the Court of his/her residence or domicile, if located on Italian Territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Marsala, any other possible Court excluded.

In accordance with the article 1341 of the Italian Civil Code, the Customer declares to have read, understood and accepted the following articles present in the General Conditions: 6 (liability for delays in the delivery), 8 (right to correct errors – exclusions or exemptions of accountability)
